Please remove branches and foliage overhanging the streets

We ask private landowners to remove any greenery that extends over property fences into sidewalks and roads, restricting both pedestrians and the movement of cleaning equipment. The greenery must also not obscure traffic signs and street name markings. The dormant season from late November to late March is an ideal time to remove overgrown branches and greenery.

Technical services use different equipment to keep pavements and roads clean and it is necessary that the clearance height above the pavements is at least 2.5 m and above the road at least 3.5 m. Pedestrians and mothers with prams will appreciate not having to avoid branches protruding from fences into the pavements.

The obligation of the landowner to maintain the greenery so that it does not overgrow into the roads and does not obscure traffic signs stems in particular from the following provisions:

  • Act No. 114/1992 Coll., on the Protection of Nature and Landscape - Section 7 (2) obliges the owner of trees on the land to treat and maintain them.
  • Act No. 13/1997 Coll., on Roads - it contains regulations for vegetation along roads, among others that vegetation must not endanger the safety of road use or make it disproportionately difficult to use the road.
  • Act No. 89/2012 Coll., Civil Code - Section 507 states that the vegetation on the land is part of the land, thus confirming the owner's obligation to care for it.
